Weekly Commentary: If Court Ultimately Bars Netanyahu It Won't Bring Left To
Power

The law clearly states that someone charged with a crime may serve as prime
minister until his case has gone completely through the system.

Last week the Supreme Court declined to rule now if Netanyahu could form the
next government, leaving open the possibility that they may opt to go beyond
the letter of the law after the elections and bar Netanyahu.

Would such a move bring the left to power?

Not if the national camp has 61 seats.

Yes. The national camp would be furious that the court went beyond the
letter of the law to defy the will of the people. But that doesn't mean
that the camp would spend its time at protest rallies rather than on forming
a government.

The Likud bylaws clearly state that the only Likud MK who may serve as prime
minister is the Likud party chairman. But should the court have the
audacity to bar Netanyahu the Likud institutions have the tools to
facilitate a different Likud MK forming the government.

Suffice it to say that should such a scenario transpire we could expect a
flurry of legislative activity to restore the balance between the judicial
branch and the executive and legislative branches.
