Trial of Ahmed Barghouti, responsible for numerous terrorist attacks, begins
in Beit-El today.
The trial of Ahmed Talleb Mustafa Barghouti, nephew of Marwan Barghouti,
opens today in the Military court in Beit-El.
Ahmed Barghouti is accused of planning and organizing many shooting attacks,
resulting in the deaths of 11 Israelis and the wounding of dozens more.
Among the shooting attacks masterminded by Barghouti are an attack in the
Atarot industrial area and one on Road 443.

Security forces arrested Ahmed Barghouti on 15 April 2002. He has been
active in the Tanzim movement of the Fatah as a driver for his uncle, Marwan
Barghouti, since 1996. Since early 2001 he has been involved in planning and
organizing terrorist attacks against Israeli targets, both military and
civilian.

As a member of the Tanzim, Ahmed transferred tens of thousands of shekels to
the heads of the El-Aqsa Martyr's Brigade, the military wing of the Fatah.
This money was used to buy weapons for attacking Israeli targets. He was in
constant contact with the heads of the El-Aqsa Martyr's Brigade in Nablus,
Jenin, Bethlehem and Hebron, as well as with the head of the Fatah, Marwan
Barghouti.

The State of Israel versus Marwan Ben Hatib Barghouti

Summary

The State of Israel has charged Marwan Barghouti, senior advisor to Yasser
Arafat and leader in the Tanzim organization with 15 counts of criminal
action, including murder, attempted murder and other terrorist activities.
Through his direct and indirect involvement, the State contends that
Barghouti is guilty of the murder and maiming of hundreds of Israeli
citizens and soldiers. In many cases, he directly ordered the staging of
terrorist attacks, and in other cases, he knowingly financed activities and
supplied weapons for attacks that resulted in death and injury.

Following is a translation of the charges filed against Marwan Barghouti in
the Tel-Aviv-Yafo District Court on August 14, 2002:

The accused is charged with heading a terrorist organization in Judea and
Samaria and abetted terrorist activities in Judea, Samaria and within
Israel.

The above is charged with the following counts:

- Pre-meditated murder

- Abetting murder

- Soliciting murder

- Attempted murder

- Conspiring to commit crimes

- Active in terrorist organization

- Belonging to a terrorist organization.

Charge Sheet

1. Towards the end of September 2000 or thereabouts, violent disturbances
staged by

Palestinian elements and coined "the Al-Aksa Intifada" erupted and continue
to this date (hereunder: the relevant period for the purposes of this charge
sheet).

These violent events include continuous and intensive terrorist activity
against
Israeli targets, including suicide bombings and murderous shooting attacks
resulting in the deaths of hundreds of Israeli citizens and soldiers as well
as severe
injury to hundreds of others (hereunder referred to as terrorist
activities).

The main Palestinian groups involved in perpetrating terrorist acts against
Israel in
the relevant period for the purposes of this charge sheet are:

"Fatah" - (The Movement for the National Liberation of Palestine) - the
organization's flag carries the inscription "Armed Struggle - Liberation of
Palestine through violence". Fatah is defined as a terrorist organization in
terms the "Prevention of Terror Ordinance - 1948 (hereunder: prevention of
terror ordinance).

"Tanzim" - an organization which spearheaded numerous Fatah activities in
Judea and Samaria and Gaza. In the relevant period for the purposes of this
charge sheet, this group has been carrying out a violent armed struggle
including acts of terror against Israeli civilians and soldiers. The Tanzim
is defined as a terrorist organization in terms of the Prevention of Terror
Ordinance.

"Al-Aksa Martyrs' Brigade" (Kata'ib Shuchda Alaktza) - a subgroup of
Tanzim who have committed terrorist acts against Israeli targets during the
relevant period for the purposes of this charge sheet; adopted the name "Al
Aksa
Martyrs' Brigade" and used this name when claiming responsibility for
terrorist
acts.
This group is defined as a terrorist organization in terms of the Prevention
of Terror Ordinance.

Fatah, Tanzim and Al Aksa Martyrs' Brigade collectively are referred to as
terrorist organizations for the purpose of this charge sheet.

3. The accused, a resident of Ramallah, led the terrorist organizations in
Judea and Samaria, and as such played a central role in all their decision
making processes.

The accused was subordinate to Yasser Arafat, who is the recognized head of
all of these terrorist organizations.

4. During the relevant period, for the purposes of this charge sheet, the
terrorist organizations were involved in intensive terrorist activities
against Israeli targets, in accordance with the policies determined by the
organizations' leaders.

5. The accused led, managed, and instigated terrorist activities against
Israeli targets by conspiring with senior field operators responsible for
implementing terrorist acts in accordance with the above stated policy, the
terms of which the accused was involved in fulfilling. The leading and
senior terrorists with whom the accused conspired to commit terrorist acts
under his leadership included: Nasser Awis, Achmed Barghouti, Natser Abu
Hamid, Raa'd Karmi, Mahgad Diriya (Abu Halawe), Machmed Matzlah (Abu Satha),
Manzour Sharim and Mahmoud Titi (hereunder: field commanders).

Achmed Barghouti served as the accused's assistant and right-hand man in his
contacts with other field commanders.

The field commanders perpetrated terrorist acts by conspiring with field
operators under their command and who acted in accordance with their
instructions.

6. When a decision was reached by the leadership of the terrorist
organizations to cease terror activities due to various circumstances,
policies or other constraints, the accused instructed the field commanders
and their subordinate operators to cease terror activities.

The conclusion that is drawn from this pattern is that during the relevant
period for the purposes of this charge sheet, the accused failed to issue
specific instructions to cease terrorist activities, and terrorist
commanders and operators continued perpetrating acts of terror in accordance
with the policies of the leadership of the terrorist organizations during
the entire period, as detailed above.

7. In the framework of conspiring to commit acts of terror and to promote
these, the accused and his subordinates implemented a series of actions
which promoted and laid the ground for the implementation of terrorist
activities.

8. a. The accused, who led, directed, and instigated terrorist activities,
was aware of the activities of the field commanders and terror activists
under their control, and he was updated as to their activities, directly and
indirectly. A case in point is the terrorist attack on the Tel Aviv "Sea
Food Market" restaurant, as detailed below.

b. On 5/3/02 at 02:30 or thereabouts, the terrorist Ibrahim Hassouna arrived
at the "Sea Food Market" restaurant on Menachem Begin Street, Tel Aviv,
armed with an M-16 rifle, hand grenades and a knife for the purpose of
perpetrating a murderous terror attack.

(1) At the time the restaurant was filled with dozens of diners. Hassouna
reached the "Beit Ma'ariv" bridge opposite the restaurant in the
aforementioned street, and started firing at the diners with the intention
of murdering as many diners as possible. He then tossed hand grenades into
the restaurant, which failed to explode. Had these grenades exploded, the
death and injury count would have been considerably higher. Immediately
thereafter Hassouna approached the restaurant and stabbed the diners who got
in his way. He committed these actions for the sole purpose of intentionally
causing the deaths of as many Israelis as possible.

(2). Immediately after Hassouna began firing at the diners, as described
above, the police were summoned to the spot. One of the first policemen to
arrive at the scene was the late Staff Sergeant Major Salim Berikat z"l who
stormed towards Hassouna in order to stop him from continuing his murderous
acts. Hassouna stabbed Staff Sergeant Major Salim Berikat several times,
including in the neck, with the purpose of killing him.

(3) Hassouna thereby deliberately caused the death of Staff Sergeant Major
Salim Berikat, aged 33, who died of fatal stab wounds inflicted by Hassouna
in the chest and other parts of the body as well as a bullet wound in his
leg. Eliyahu Dahan, aged 53, was also stabbed to death by Hassouna in the
back and stomach. Hassouna's actions as described above, which were intended
to cause grave damage, resulted in dozens of injuries, including several who
were seriously wounded.

(4) Hassouna was shot to death by security forces who arrived on the scene.

(5) Hassouna was recruited for the purpose of perpetrating the above attack
shortly before 5.3.02 by Nasser Awis, who was a senior and major field
commander during the relevant period for the purposes of this charge sheet.

(6) Awis conspired with Achmed Barghouti, Machmed Titi and additional
activists to perpetrate a terrorist attack with the purpose of intentionally
causing the deaths of a large number of Israelis and the accused was aware
of these activities. In order to facilitate and implement these murderous
deeds, those responsible provided Hassouna with firearms, videotaped his
"suicide" message, and made all the logistical arrangements necessary for
the attack.

(7) On the above date, shortly prior to the attack, Hassouna was driven by
several operators who were part of the conspiracy to the scene of the
planned attack.

On their way to the scene, Achmed Barghouti informed the accused of a
planned attack. The accused authorized an attack, but requested that it be
perpetrated in Judea and Samaria and not within Israel itself.

(8) Shortly after the attack took place, at 03:00 a.m. or thereabouts,
Achmed called the accused to report that the attack had taken place and that
the events were being broadcast on TV. The accused replied that he was
watching the broadcast and knew about the attack. He requested that Nasser
Awis consult with him before issuing a declaration that the terrorist
organization claims responsibility for perpetrating the terror attack.

9. a. The accused and field commanders engaged in recruiting members to the
terrorist organizations. In addition, they operated, coaxed and encouraged
terror activists, including those recruited by them in the relevant period
for the purposes of this charge sheet, to commit acts of terror. In addition
they handled all logistical issues necessary for perpetrating these acts.

b. (1) In May 2001, within the framework of the above activities, Ismail
Radaira (hereunder: "Ismail"), approached the accused requesting to join the
terrorist forces with the intention of committing a suicide bombing.

In reply, the accused informed him that he was prepared to supply him with
the necessary weapons for the purpose of perpetrating a shooting attack on
soldiers and settlers. Immediately after, the accused referred Ismail to Abu
Halawe, an engineer and field operator, aware that Halawe was in charge of a
terrorist cell active in perpetrating terrorist attacks on Israeli targets.

(2) On the following day, the engineer Halawe supplied Ismail with two fully
loaded Kalachnikov rifles and a packet containing additional bullets.

(3) On 12.06.01, Ismail, accompanied by another activist, ambushed a car on
the road from Jerusalem to Ma'aleh Adumim. At 22:40 or thereabouts, Ismail
fired a round of 13 bullets from the Kalachnikov rifle and intentionally
caused the death of Chipokatkis Germanos, a Greek Orthodox monk.

(4) At a later date, Ismail received additional weapons from Abu Halawe for
the purpose of perpetrating a terrorist attack at the Mt. Scopus campus of
the Hebrew University in Jerusalem. Soon after Germanos' murder, Halawe and
his subordinates informed the accused that this act was perpetrated by
Ismail, who had been referred by him to Halawe, as described above.

10. The accused was involved in financing and organizing training facilities
for newly enlisted and veteran terror activists for the purpose of
committing acts of terror.

The above facilities provided training in the use of various types of
firearms, physical fitness, etc.

11. a. The accused was involved in the acquisition of firearms and other
incendiary weapons, including assault rifles, explosive belts, mortars, hand
grenades, etc. for the purpose of perpetrating terrorist acts.

The accused also financed the purchase of weapons supplied by Achmed Leziar
Hammuda, an activist who was, inter alia, involved in the murder of two
Israeli soldiers who were lynched in the Ramallah police station. Ziyad
Hammuda, together with other terrorists, used these weapons to commit
several shooting attacks on the village of Psagot.

In addition, the accused financed the acquisition of a mortar for Natzer Abu
Hamid, who used it to carry out a failed attack.

b. The accused coordinated a wide range of finance-related activities for
the purpose of acquiring weapons from various sources based on written and
verbal requests for these supplies from field commanders and terror
activists. The accused was involved in procuring finances by referring the
above requests together with his recommendations to Yasser Arafat and other
sources.

In addition, in certain instances the accused was involved in financing the
procurement of weaponry as per requests received from his own sources.

The above activities, in which the accused was involved, provided field
commanders and terror activists with access to finances for the purpose of
acquiring weapons to be used in perpetrating terrorist attacks.

c. A case in point was a request by a terror activist, Jihad Je'ara, for the
accused to finance activities for the purpose of perpetrating an act of
terror.

The accused referred Je'ara to Achmed, who then informed the accused that
Je'ara intended to carry out a terrorist attack in Jerusalem. The accused
authorized the attack, but requested that the attack not be carried out
within Israel. On the morning of 26.03.02, the terrorists who conspired with
Je'ara to perpetrate an act of terror at Jerusalem's Malcha Shopping Mall
set out to intentionally cause the death of many Israelis.

The mission failed as the terrorists were apprehended by IDF soldiers at one
of the checkpoints on the road to Jerusalem. One of the terrorists was shot.

12. The accused controlled the field commanders and terror activists by
providing financial support and meeting the various needs of these groups,
including subsistence and living expenses.

In this capacity, the accused devised a system whereby most requests for
financial assistance were referred to him verbally or in writing by the
field commanders and terror activists. The accused examined the requests and
gave priority to requests for assistance to activists who had already
committed acts of terror against Israel, including those declared by Israel
to be wanted terrorists, or who had been injured during one of these
attacks.

In some instances, the accused instructed his financial people, including
Ali Barghouti, as to which requests to approve and determined the amount to
be paid.

In other instances the accused referred requests endorsed with his
recommendation to Yasser Arafat, who decided whether to approve the request
and determined the amount to be paid.

The accused also handled requests to promote activists within the
organizational framework of the terrorist groups as well as requests to
place activists in prominent positions in the various sub-organizations
financed by Yasser Arafat.

In providing financial backing and promoting activists according to the
priorities as detailed above, the accused coaxed, encouraged and laid the
groundwork for activists to dedicate themselves exclusively to committing
acts of terror while being relieved of the burden of supporting their
families. For his role in backing terrorists financially, as well as
promoting and instigating terrorist activity, the accused is responsible for
increasing acts of terror against Israel.

13. a. The accused's actions caused increased motivation and willingness by
terrorist organization members to commit acts of terror against Israel by
coaxing and encouraging them with speeches of incitement against the State
of Israel in the various media and at gatherings, as well as via the
distribution of seditious printed material.

The accused used the above speeches and printed proclamations to call for
acts of revenge against Israel, to praise and glorify all those involved in
committing acts of terror against Israeli targets, and to confer "holy
martyrdom" on terrorists injured while perpetrating these terror attacks.

In reaction to the attempts of Israel's security forces to wipe out
terrorist activities, the accused declared that terrorists (whom he called
"heroes"), "would burst into Israeli cities and commit hit after hit," with
the aim of undermining the Israeli population's sense of security. The
accused led numerous mass demonstrations attended by terrorist organization
activists, many of whom were armed.

During these demonstrations participants made a habit of confronting IDF
soldiers with disturbances and violence with the intention of provoking
seditious incitement and to encourage other activists to enlist into the
ranks of the terror organizations.

By initiating the above actions, the accused was responsible for increasing
the willingness of many people to join terrorist organizations and
successfully encouraged and persuaded field commanders and operators to
commit terrorist acts, including murderous acts of revenge against Israeli
targets.

b. A typical such event occurred when the accused set up a "house of
mourning" on 14.1.02 after the death of Raa'id Karmi, a senior field
commander. Many field commanders and terror activists gathered in the
evening of the above date in the house of mourning. The accused called upon
Achmed Barghouti and others present to implement a terror attack to avenge
the death of Raiyad Karmi. Shortly thereafter, Achmed began implementing the
accused's instructions and supplied weapons to Machmed Matzlah (Abu Satha),
a field commander, who conspired with Achmed and other activists from the
terror cell under his command to implement the act of terror as ordered by
the accused. On 15.1.02, Machmed Matzlah and other cell members lay in wait
on route 443, near the Givat Ze'ev gas station. At 19:45 Machmed Matzlah and
other cell members approached a car belonging to the late Yoella Chen z"l
which was standing near the gas station. They spoke to her in order to
confirm that she was an Israeli. Machmed Matzlah and another cell member
fired a round of bullets at Yoella Chen and Rachelle Eini who was also in
the car thereby intentionally causing the death of Yoella Chen and
attempting to unlawfully cause the death of Rachelle Eini, who was injured.
Immediately following the attack Achmed informed the accused of the murder
he had committed in revenge, as per the accused's instructions.

14. The accused, who led the terrorist organizations in Judea and Samaria
and in committing the above acts, headed, operated, abetted, persuaded and
participated in acts of terror perpetrated by field commanders and terror
activists under them, as detailed in the appendix to this indictment and
thereby intentionally caused the deaths of hundred of Israelis during the
relevant period for the purposes of this charge sheet.

15. The accused, who led the terrorist organizations in Judea and Samaria
and in committing the above acts, headed, operated, abetted, persuaded and
participated in acts of terror perpetrated by field commanders and terror
activists under them, as detailed in the appendix to this indictment and
thereby attempted to illegally and intentionally cause the deaths of hundred
of Israelis.
